Transfer of a going concern under European VAT

Under European VAT, the Member States may take the position that, in the event of a transfer of a totality of assets, no supply of goods and services has taken place and that the transferee is considered to be the transferor's successor. That situation will arise, for example, where a business is transferred as a going concern. In this article, the author examines the background and scope of the no-supply rule.
